New rule to speed federal regulatory processes could ramp up interest in transportation P3s

The new rule, Private Investment Project Procedures (PIPP), which is scheduled to go into effect June 29, lines up with the administration’s goal of encouraging private investment in infrastructure projects nationwide. The President’s original infrastructure plan was for the federal government to invest $200 billion in order to encourage more than $1.5 trillion in investment revenue from other sources.

FTA: National Public Transportation Safety Plan

MAP-21 (Pub. L. 112-141 (2012)) amended Federal transit law by authorizing a new Public Transportation Safety Program at 49 U.S.C. § 5329. Pursuant to Section 5329(b), the Public Transportation Safety Program must include a National Public Transportation Safety Plan to improve the safety of all public transportation systems that receive Federal transit funds.

Therese McMillan is currently the Acting Administrator of the Federal Transit Administration (FTA). She joined FTA as Deputy Administrator on July 2, 2009. As Deputy, McMillan assisted the Administrator in leading a staff of more than 500 in the Washington D.C. headquarters office and 10 regional offices throughout the United States, and implementing an annual budget approximating $10 billion.

“The economic impact of transit investments has different faces…First, it should be recognized that any time you are building and repairing transit services, that in and of itself is creating jobs in the near term. Another thing, though, that’s important to think about in terms of economic impact, is the ability of transit to connect people to their jobs, and often to connect them in a more efficient and effective way than being caught in traffic and congestion.”

This edition of the C&P report is based primarily on data through the year 2010; consequently, the system conditions and performance measures presented should reflect effects of the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU), which authorized Federal highway and transit funding for Federal fiscal years 2005 through 2009 (and extended through fiscal year 2012), as well as some of the impact of the funding authorized under the American Recovery and Reinvestment Act of 2009 (Recovery Act). None of the impact of funding authorized under the Moving Ahead for Progress in the 21st Century Act (MAP-21) is reflected. In assessing recent trends, this report generally focuses on the 10- year period from 2000 to 2010. The prospective analyses generally cover the 20-year period ending in 2030; the investment levels associated with these scenarios are stated in constant 2010 dollars.

Outcomes of the Nonmotorized Transportation Pilot Program

Section 1807 of the Safe, Accountable, Flexible Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU) P.L. 109-59 established the Nonmotorized Transportation Pilot Program (NTPP) in August 2005.1 Over the span of 4 years, the NTPP provided roughly $25 million annually in contract authority allocated equally among four pilot communities (Columbia, Missouri; Marin County, California; Minneapolis, Minnesota; and Sheboygan County, Wisconsin) “to construct … a network of nonmotorized transportation infrastructure facilities, including sidewalks, bicycle lanes, and pedestrian and bicycle trails, that connect directly with transit stations, schools, residences, businesses, recreation areas, and other community activity centers.
